Mexican teen will be deported: judge

A Mexican teen’s effort to remain in Canada failed Friday when a Federal Court judge rejected his effort to stay a deportation order, meaning Daniel Garcia will likely be deported to Mexico on Saturday.

Garcia’s lawyers tried to argue the teenager would suffer if he were pulled out of Toronto’s Parkdale Collegiate midway through the school year, because he won’t be able to start school in Mexico until September.

“We’re talking about a kid who’s halfway through school,” said Daniel Kingwell, Garcia’s lawyer.

The Canada Border Services Agency had already rejected that notion, but, and the judge agreed.

Kingwell was disappointed and later Friday afternoon was trying to reach Garcia at the Toronto Detention Centre to give him the news.

“At this holy time of year, deporting one of Parkdale’s students is counter to everything we tell the world of Canada’s humanitarianism,” Cheri DiNovo, NDP MPP for Parkdale-High Park, said in a statement.

Kenney says teen got honest treatment

Garcia’s supporters have also questioned Immigration Minister Jason Kenney to issue him a temporary resident’s permit, but the minister said in a statement Friday morning that he couldn’t discuss the specifics of the case.

“Like all failed asylum seekers facing deportation, he has benefited from all of the rights and privileges available to asylum seekers, including access to our courts and our generous refugee determination system,” Kenney said.

“Nobody is deported until after they have exhausted their appeals. But, once that has happened, we expect them to leave our country and respect Canadian law.”

Garcia, 18, and his sister Brenda, 30, who arrived in Toronto three years ago, said they feared for their lives in Mexico. Brenda said that she was threatened in Mexico for being a lesbian and that her partner was shot to death for being gay.

The judge did not believe Brenda’s claims of persecution, and she was deported to Mexico City on Monday. Daniel was arrested last Thursday, according to friends.

Canada can’t close out Swedes

Canada suffered its first loss of the world junior hockey championship on Saturday in Buffalo, N.Y., but it has huge implications.

The Canadians dropped a close choice to Sweden 6-5 in a shootout, and missed the chance to get a bye into the semifinals.

Canada led three times in the contest but couldn’t close the game out. Now the Canadians will have to get past an opponent in the quarter-finals before a likely date with the host and defending champion Americans in the semifinal.

Habs ship Lapierre to Ducks

The Montreal Canadiens have traded centre Maxim Lapierre to the Anaheim Ducks for defenceman Brett Festerling and a fifth-round draft pick in 2012.

Lapierre has five goals and three assists in 38 games so far this season. The 25-year-ancient native of Montreal also led the Habs in hits, with 104, and penalty minutes, with 63.

The six-foot-two, 207-pounder has 40 goals and 40 assists since being drafted by the Canadiens 61st overall in 2003.

Festerling was scoreless in one appearance with Anaheim so far this season. The 24-year-ancient from Quesnel, B.C., has eight assists in 83 career NHL games.

Festerling has spent the majority of the season with the AHL’s Syracuse Crunch, where he has three goals and nine assists in 32 games.

The Canadiens announced the deal in Florida, where they were facing the Panthers on Friday afternoon.
